RIGHT TO INFORMATION ACT, 2005
CHAPTER – II, Section 4 ( 1 ), b, ( ii ).
THE POWERS AND DUTIES OF ITS OFFICERS AND EMPLOYEES
OFFICERS OF THE UNIVERSITY
Act. Sec. 9. The following shall be the Officers of the University:
- The Chancellor
- The Vice-Chancellor
- The Rector
- The Principals/Deans of the University College
- The Registrar
- The Finance Officer, and
- Such other persons as the statutes may declare to be Officers of the University.
(i) THE CHANCELLOR
Act. Sec. 10 The Governor of Andhra Pradesh shall be the Chancellor of every University established or deemed to have been established under this Act. He shall, by virtue of his office, be the Head of the University and shall, when present, preside at Convocations of the University. He shall exercise such other powers and perform such other duties as may be conferred on or vested in him by or under the provisions of this Act. The Chancellor may, by order in writing annul any proceeding of the University, which is not in conformity with this Act, the Statutes or the Ordinances:
Provided that before making any such order he shall give a notice calling upon the University to show cause why such an order should not be made, and if any cause is shown within the time specified therefor in the said notice, shall consider the same.
Act. Sec. 11. (ii). THE VICE-CHANCELLOR
(1) The Government shall constitute a Search Committee consisting of:
- a nominee of the Executive Council;
- a nominee of the University Grants Commission; and
- a nominee of the State Government.
The Search Committee shall submit a panel of three persons to the Government in alphabetical order from among whom the State Government shall recommend one person to the Chancellor for appointment as Vice-Chancellor and the Chancellor shall appoint such person as Vice-Chancellor;
Provided that it shall be competent for the Government to call for a fresh panel if they consider necessary and the Search Committee shall submit a fresh panel to the Government.
(2) The Vice-Chancellor shall not be removed from his office except by an order of the Chancellor passed on the ground of willful omission or refusal to carry out the provisions of this Act, or abuse of the powers vested in him and after due enquiry ordered by the Government, by the Lok Ayukta, or by such person who is or has been a Judge of the High Court or the Supreme Court as may be appointed by the Chancellor in which the Vice-Chancellor shall have an opportunity of making his representation against such removal.
Provided that where the enquiry is conducted by a person who is or has been a Judge of the High Court or the Supreme Court the report of such an enquiry shall be forwarded to the Government and the Chancellor shall act in accordance with the advice tendered by the Government on a consideration of the report while exercising his powers under this sub-section;
Provided further that where the Lok Ayukta enquires into an allegation against the Vice-Chancellor under the Andhra Pradesh Lok Ayukta and Upa-Lok Ayukta Act; 1983, then notwithstanding anything contained in Section 12 of that Act, the Lok Ayukta shall submit the report to the Government and the Chancellor shall act in accordance with the advice tendered by the Government on a consideration of the report while exercising his powers under this sub-section.
(3) The Vice-Chancellor shall be the academic head and the principal Executive Officer of the University and shall exercise general control over its affairs. He shall be a whole time officer of the University;
Act Sec. 12
(1) Subject to the provisions of Sub-Section (2) of Section 11, the Vice-Chancellor shall hold office for a term of three years from the date of his appointment and shall be eligible for reappointment to that office for another term of three years in the manner provided in Sub-section (1) of Section 11.
(2) The Vice-Chancellor shall be paid such pay and allowances as may, by order, be specified by the Government from time to time. He shall be provided with a furnished official accommodation for which he shall pay ten per cent of his salary towards rent.
(3) When the Vice-Chancellor is unable to exercise his powers, perform his functions and discharge his duties owing to absence, illness or any other cause or when the office of Vice-Chancellor is vacant, it shall be competent for the State Government to appoint a person to be in-charge Vice-Chancellor. The person so appointed as in-charge Vice-Chancellor shall exercise the powers, perform the functions and discharge the duties of the Vice-Chancellor until the Vice-Chancellor assumes the office, or as the case may be, a new Vice-Chancellor is appointed in accordance with Sub-section (1) of Sec. 11.
(4) It shall be competent for the Chancellor to accept the resignation of the Vice-Chancellor.
(5) When the post of the Vice-Chancellor falls permanently vacant, either by resignation or otherwise, the vacancy shall be filled by the Chancellor by appointing another person as the Vice-Chancellor and the Vice-Chancellor so appointed shall hold office for a full term of three years.
Act Sec. 13
(1) The Vice-Chancellor shall, by virtue of his office be a member and Chairman of the Executive Council and the Academic Senate and shall preside at the Convocation of the University in the absence of the Chancellor.
(2) He shall be entitled to be present at the address at any stage, of any meeting of any Authority of the University, but not to vote thereat, unless he is a member of the authority concerned.
(3) He shall have the power to convene meetings of the Executive Council and the Academic Senate.
(4) It shall be his duty to see that the provisions of this Act, the Statutes, the Ordinances and Regulations are duly observed and he may exercise all powers necessary for this purpose.
(5) He shall have power to interpret the provisions of this Act, the Statutes the Ordinances and the Regulations. Any person or authority aggrieved may, within such time as may be prescribed by an Ordinance, appeal to the Chancellor;
Provided that:
(I) if such interpretation was given at a meeting of the Executive Council the appeal shall lie to the Chancellor direct;
(ii) if such interpretation was given otherwise than at a meeting of the Executive Council, the appeal shall be forwarded to the Chancellor through the Executive Council.
The decision of the Chancellor on the appeal shall be final.
(6) He shall give effect to the decision of the Authorities of the University taken in accordance with the powers conferred by or under this Act.
(7) He shall have such other powers as may be prescribed.
(8) (a) When, with regard to any matter in which any officer or authority may take action the Vice-Chancellor considers immediate action desirable, he may, subject to the general control of the Chancellor, take such action as may be necessary but shall as soon as may be, report the action taken to the effect to the authority concerned.
(b) An appeal shall lie to the Executive Council against any action taken by the Vice-Chancellor under clause (a) affecting any person in the service of the University, at the instance of such person. Such appeal shall be filed within thirty days from the day on which such person has notice of the action taken.
ADDITIONAL POWERS AND DUTIES
(i) Convening and presiding over the meetings of the Selection Committee
The meetings of the Selection Committee shall be convened and presided over by the Vice-Chancellor, unless otherwise provided in the Statutes made in this behalf.
(ii) Protection of Emoluments and conditions of service of the Vice-Chancellor reappointed for the second term.
Notwithstanding anything contained in clause (2) of Section 12 of the University Act, if the Vice-Chancellor appointed under the provision to sub-section (1) of Section 11 is reappointed under Section 12 (1) for a second term, the emoluments and other conditions of service of the Vice-Chancellor so reappointed for the second term shall be such as may be determined by the Government and shall not be varied to the Vice-Chancellor’s disadvantage on such reappointment.Protection of Emoluments and conditions of service of the Vice-Chancellor appointed from the service of the State or Central Government or All India Service or other University Service.
Notwithstanding anything contained in clause (2) of Section 12 of the Act, the Government may determine the emoluments and other conditions of service of an officer in the service of the State or Central Government or a member of an All India Service or of other University appointed as Vice-Chancellor, in a manner not less advantageous than the terms and conditions by which the person appointed as Vice-Chancellor is governed as a member of the service to which he belongs.
(iii) He shall be responsible for the maintenance of discipline among the staff, students and servants of the University and shall have powers necessary for the purpose.
(iv) He shall have the right to inspect all colleges, schools, centres, special laboratories and other institutions of the University and he may express his views thereon to the appropriate Officer or authority of the University for taking thereon such action as may be deemed fit and proper.
He shall also have power to visit any research institution for the purpose of according it recognition or for negotiating the terms and conditions for taking over by the University and obtain the concurrence of the Executive Council for the said purpose.
(V) He shall have power to institute an enquiry in respect of any matter concerning the University.
- He shall have power to constitute such ad hoc committees as he may deem necessary to help him in the performance of his duties as the Principal Executive Officer of the University.
- Where an officer is absent from duty on leave or for any other reason, or whenever any post has not been filled up, the Vice-Chancellor may make such arrangements as may be necessary for the proper discharge of duties of that office for such period as may be necessary.
- He shall exercise such financial powers as may be prescribed from time to time.
- Representation of the University in other organizations:
The Vice-Chancellor shall be the representative of the University on the Association of Indian Universities, the Association of Commonwealth Universities and other similar bodies or Associations in India or abroad. In case he is unable to attend meetings he may depute a person to represent the University at such meetings with the concurrence of the Executive Council.
If the Vice-Chancellor is deputed by the Executive Council on University business to countries outside India, then the fact of such deputation shall be communicated to the Government, which shall be competent to appoint a person to be in-charge Vice-Chancellor, during the absence of the Vice-Chancellor.(x) LEAVE
(a) The Vice-Chancellor shall be entitled to leave on full pay at the rate of 15 days per each half year, which shall be credited to his earned leave account on full pay, in advance of the half year, on 1st January and 1st July every year. If he is appointed after the commencement of a half year, his earned leave account on full pay shall be credited at the rate of 2? days for each completed month of service which he is likely to render in the calendar half year in which he is appointed. Similarly, if he quits the service either due to retirement, resignation, or is due to retire, his earned leave account shall be revised duly affording the credit only at the rate of two and half days per completed month in that half year up to the date of retirement or resignation. In the event of the same incumbent being reappointed for a further term continuously he shall be entitled, in addition to the leave admissible as above, to leave on full pay for such unexhausted period of leave on full pay as may remain to his credit in the previous term of office.
(b) He shall also be entitled, in case of illness or on account of private affairs, to leave without pay for a period not exceeding three months during any three-year tenure of office; provided that such leave taken without pay may be subsequently converted into leave on full pay to the extent to which it may be subsequently earned after return to duty.
(iii) THE RECTOR
Act Sec.14 There shall be a Rector who shall be appointed by the Executive Council on the recommendations of the Vice-Chancellor in such manner and on such terms and conditions as may be prescribed by the Statutes from among the senior Professors. He shall exercise such powers and perform such duties as may be prescribed by the Statutes.
ADDITIONAL STATUTESTERMS OFAPPOINTMENT
The Rector shall be appointed for one year at a time, and shall be eligible to be reappointed, provided, however, that the same person shall not hold office of Rector for more than three years.
SALARY
The monthly salary of the Rector shall be an amount equal to the pay and other allowances drawn by him as Professor and personal pay at such rate as may be fixed by the Executive Council from time to time. He shall also be entitled to such perquisites as may be fixed by the Executive Council on the recommendation of the Vice-Chancellor.
WHOLE-TIME OFFICER
The Rector shall be a whole-time officer, provided, however, that the Vice-Chancellor may permit him to engage in any teaching work or research guidance, as Professor.
ALTERNATIVE ARRANGEMENT DURING THE VACANCY OF THE OFFICE OF THE RECTORWhen the office of the Rector is vacant or when the Rector is by reason of illness, absence or any other cause, unable to perform the duties of his office, the duties of the office shall be performed by such person as the Vice-Chancellor may appoint for the purpose.
PRESIDING OVER MEETINGS
Subject to provisions in the Act, where the Vice-Chancellor is the Chairman of any Body or Committee of the University and he is absent for any reason whatsoever from any meeting of such Body or Committee, the Rector shall preside over such meeting except in the case of the Selection Committee.
POWER TO ADDRESS AT ANY MEETING
The Rector shall, on being authorised by the Vice-Chancellor in that behalf, be entitled to be present at and to address any meeting of any authority, Body or Committee of the University but shall not be entitled to vote thereat unless he be a member of that Committee, Body or Authority.
POWERS AND DUTIES ENTRUSTED BY THE VICE-CHANCELLOR
The Rector shall exercise such powers and perform such duties and functions in regard to the matters which may be entrusted or delegated to him by the Vice-Chancellor. The Vice-Chancellor may, however, suo motu or otherwise, revise, amend, alter or annul any order of or action taken by the Rector.
LEAVE, Etc.
Save as otherwise provided, Officers other than the Chancellor, and the Vice-Chancellor shall be governed, as regards leave, Provident Fund, Pension, Insurance, retirement benefits and disciplinary matters, by the Statutes relating to the conditions of service, prescribed by the University from time to time.
RESIGNATION
The Rector may resign his office by submitting a letter to that effect to the Vice-Chancellor. The Rector shall be liable for removal from his office by the Vice-Chancellor by giving one month’s notice for such removal or one month’s personal pay in lieu of such notice.
(iv) PRINCIPAL OF THE UNIVERSITY COLLEGE/ DEAN OF THE SCHOOL ADDITIONAL STATUTES
APPOINTMENT
Principal of the University College/Dean of the School shall be appointed by the Vice-Chancellor on the basis of seniority by rotation from among Professors of the University College.
The Principal/Dean shall hold office for a period of three years and is not eligible for reappointment till the rotation is completed.EMOLUMENTS
The Principal of the University College/Dean of the School shall be paid monthly such duty allowance as may be fixed by the Executive Council besides pay and allowances drawn by him as Professor.
POWERS AND DUTIES
TEACHING WORK
The Principal shall ordinarily do not less than three hours of teaching work per week plus such practical work as may be necessary.
ADMINISTRATIVE FUNCTIONS
Subject to the general control of the Vice-Chancellor, the Principal/Dean shall exercise the following powers and duties:
- He shall be responsible for admission of students to the University College.
- He shall supervise the conduct of entrance examination for admission to various courses offered in the College.
- He shall supervise the enrolment and progress of the students of the College.
- He shall coordinate and generally supervise the teaching and research work in the Departments through the Heads of the Departments concerned.
- He shall take steps to promote inter-disciplinary teaching and research, wherever necessary.
- He shall review from time to time the work and progress of the projects implemented in the Departments along with the Head of the Department, other Teachers and Researchers in the respective Department.
- He shall review the budget estimates of each Department and propose changes, required if any, for the effective implementation of the research projects or/and studies.
- He shall preside over the meetings of the College Council.
- Without prejudice to the right of any member to represent any matter to the College Council, he shall formulate and present policies to the College Council for its consideration and transmission to the University for approval.
- He shall take steps to give effect to the decisions of the College Council and Committees.
- He shall submit reports periodically to the Vice-Chancellor on the working of the College.
- He shall prepare the Annual Budget for the entire College in consultation with the Heads of the Departments and forward the same to the University.
- He shall maintain discipline in the College through the Heads of the Departments.
- He shall arrange for the conduct of University Examinations in respect of the students of the College in accordance with such directions as may be given by the University.
- He shall, with respect to the employees working under him, exercise powers of drawing, disbursing and collection of money under relevant Statutes, Ordinances and Regulations.
- He shall grant casual leave to the teachers of the Faculty.
- He shall countersign TA Bills of the employees working under him.
- The Principal shall be in-charge of all Institutions in the campus connected with the University College, Hostels, Societies, Play fields, Workshops, etc., and be responsible for the smooth and efficient working of the Institutions and for their internal administration. It shall be his duty to satisfy himself that the work of the College is being carried out methodically in accordance with the general programme.
- He shall perform such other duties as may be assigned to him by the Executive Council, Academic Senate, Planning and Monitoring Board or the Vice-Chancellor.
DELEGATION OF POWERS
He shall have the power to allot such of his functions to be discharged, subject to his directions and control, by such of the subordinate officers as he may from time to time decide.
Being the Head of the College, all correspondence relating to the College shall, however, be routed through him.DECLINING THE OFFER OF APPOINTMENT
It shall be open to a Senior Professor to decline the offer of appointment as the Principal, in which case the Vice-Chancellor shall appoint the next senior Professor as Principal.
FILLING OF VACANCY
When the office of the Principal is vacant or when the Principal is, by reason of illness, absence or any other cause, unable to perform duties of his office, the duties of the office shall be performed by the Vice-Principal, or any person as the Vice-Chancellor may appoint temporarily for the purpose, until permanent arrangements are made.
RESIGNATION
The Principal of the College may resign his office at any time during his tenure of office. He shall submit his resignation letter to the Vice-Chancellor for consideration and decision thereon.(v) REGISTRAR
Act Sec 15
(1) The Registrar shall be a whole time paid officer of the University appointed by the Executive Council for a term of three years or less and on such terms and conditions as may be prescribed by the Statutes, provided that he shall not continue in that office for more than six years.
(2) The Registrar shall act as the Secretary of the Executive Council and Academic Senate. He shall exercise such powers and perform such duties as may be prescribed.
(3) The Executive Council may transfer the Registrar to a suitable position even before the completion of the term provided he is shown a position in the University with the same emoluments.
1. EXECUTION OF AGREEMENT
An agreement shall be executed by the Registrar within one month from the date of his taking charge of office in proper form as prescribed on a non-judicial stamp paper at his cost of the value required by law for the time being in force and delivered to the University.
2. SUITS: In all suits and legal proceedings for or against the University, the proceedings shall be signed and verified by the Registrar and all processes in such suits or proceedings shall be issued to and served on the Registrar.
ADDITIONAL POWERS AND DUTIES
In addition to the powers and duties conferred by the Act, the Registrar shall exercise the following powers and duties namely:-
(3) He shall be the custodian of the records, common seal and such other properties of the University as the Executive Council may commit to his charge.
(4) He shall, in execution of his office, be subject to the immediate direction and control of the Vice-Chancellor and shall render generally such assistance as may be required by him in the performance of his official duties.
(5) Subject to the general direction and control of the Vice-Chancellor
- The Registrar shall be in-charge of the administration of the University Office.
- He shall take all steps for the efficient working of the University Office.
- He shall have power to fix and define functions and duties of the non-teaching employees of the University.
- He shall be responsible for the general discipline of the University Office and shall have disciplinary control over the employees of the University Office.
- He shall conduct official correspondence of the University and be responsible for the proper maintenance of all the records of the University.
- He shall issue notices concerning meetings of the Executive Council, Academic Senate, Planning and Monitoring Board, Finance Committee and Selection Committee;
- Save as otherwise provided, he shall attend the meetings of the above authorities and maintain the minutes thereof, but shall not have powers to vote thereat, unless he is a member of that Authority/ Body/ Committee;
- He shall exercise such financial powers as may be prescribed from time to time;
- He shall forward applications of the non-teaching employees of the University service, for appointments outside the University subject to the service conditions laid down in the Statutes;
- He shall perform such other work as may be required for carrying on the day-to-day administration of the University.
6. ACCESS TO UNIVERSITY RECORDS
He shall, on application previously made by any member of the Executive Council, of the Academic Senate, or of a Faculty, for the perusal of the proceedings of the Executive Council, Academic Senate or Faculty respectively, and any documents connected with such proceedings, fix, with the approval of the Vice-Chancellor, a convenient hour and date, which shall ordinarily be within ten days of the receipt of application and arrange for the perusal of the said proceedings and any document connected with such proceedings at the said hour and date. If, however, there is any difficulty in furnishing any record asked for by the member, he should inform the Executive Council, Academic Senate or Faculty, as the case may be, accordingly at the meeting of the concerned authority following the member’s requisition.
7. LEAVE
With the prior permission of the Vice-Chancellor, the Registrar shall avail himself of all kinds of leave applicable to superior service of Non-Teaching Department. The Registrar shall be paid Travelling Allowance for journeys made on University business at the rates admissible to members of the Executive Council.
8. SUSPENSION Etc.
The Executive Council shall have power, upon sufficient cause shown and after giving an opportunity to explain, to suspend the Registrar from office and from emoluments thereof in whole or in part for any period not exceeding one year.
9. RESIGNATION
The Registrar may by writing inform the Vice-Chancellor of his intention to resign or revert to his parent department. It shall be competent for the Executive Council on the recommendation of the Vice-Chancellor to accept his resignation or reversion.
Provided, however, that he shall not be permitted to resign his appointment unless he gives one month’s notice of his intention to resign.
(vi) THE FINANCE OFFICER
Act Sec.16.
(1) The Finance Officer shall be a whole-time officer of the University appointed by the University from out of a panel of three officers to be obtained from the Government in the Education Department on such terms and conditions as may be prescribed by the rules made by the Government in this behalf. He shall be the employee of the Government and the salary, allowances, pension and other remuneration shall be paid in the first instance out of the consolidated Funds of the State and later recovered from the University.
2. He shall maintain the accounts of the University and also advise the University on all matters relating to income and expenditure.
3. He shall be present at the meetings of the Finance Committee and participate in the discussions but shall not be entitled to vote.
ADDITIONAL STATUTES
1. Subject to the statutes, the University may appoint the Finance Officer from among the qualified, eligible Deputy Registrars or equivalent cadre.
2. ARRANGEMENTS FOR THE MEETINGS OF THE FINANCE COMMITTEE
The Finance Officer shall make all arrangements for the transaction of business of the meetings of the Finance Committee, under the guidance and supervision of the Vice-Chancellor and the Registrar.3. ADDITIONAL POWERS
In addition to the powers conferred upon the Finance Officer by the Act, the Finance Officer shall exercise the following powers and duties:-
(i) The Finance Officer shall be incharge of the Finance, Accounts and Audit branch of the University.
(ii) He shall fix the duties and responsibilities of the Deputy Registrars, Assistant Registrars and other staff working under him, exercise control over them and assess their work and performance.
(iii) He shall be the principal adviser of the University on all matters connected with Finance, Accounts and Audit of the University.
(iv) He shall make recommendations, whenever he deems necessary, to the Executive Council on all matters relating to the Finance, Accounts and Audit of the University.
(v) He shall suggest any new account or audit form or register considered necessary or suggest alteration to any existing form or register suitably for the proper working of the University Office and the subordinate offices, for the approval of the Finance Committee and the Executive Council.
(vi) He shall take necessary steps to realise and receive grants or other moneys due to the University from the Central Government, State Governments, University Grants Commission and other bodies, institutions or individuals.
(vii) He shall see that all payments received by the University are credited to the University Funds and he shall arrange to issue cheques on behalf of the University for all authorized payments out of the University Funds.
(viii) He shall scrutinize every item of new expenditure not provided for in the budget estimates of the University.
(ix) He shall disburse all salary bills including arrears of salary, contingent bills like electricity, water, land and municipal tax, phone and other rental bills, recoup permanent advances, arrange to pay all TA Bills, after ensuring that general sanction is received from the competent authorities.
(x) He shall sanction payment of bills submitted by various Departments of the Governments, Institutions, Organizations and other bodies, for supplies effected on the basis of the orders placed by the competent authorities of the University, if there is budget allotment.
(xi) With the approval of the Vice-Chancellor he shall invest in deposits, securities etc., which shall be reported to the Finance Committee and the Executive Council, immediately at their next meeting.
(xii) It shall also be the duty of the Finance Officer to make arrangements for the audit and payments of bills presented at the University Office.
(xiii) He shall arrange to settle objections raised by the Audit appointed by the Government and carry out, after obtaining the approval of the Executive Council, such instructions as may be issued by the Government on that Audit Report.
(xiv) He shall help the University in publishing the Audited Accounts so that they may be submitted to the Executive Council and to the Government within three months of such publication.
(xv) To meet the day to day requirements of the Finance Section, he shall sanction petty claims of contingent expenditure up to Rs.10,000/- only at a time.
(xvi) He shall, after obtaining necessary quotations, sanction purchases for the Finance Section not exceeding Rs.10,000/- only if such purchases are urgent and if budgetary provisions are available.
(xvii) He shall have power to countersign TA Bills of the employees working under him.
(xviii) He shall perform such other duties as may be required from time to time, by the Executive Council or the Vice-Chancellor.
DUE DATES FOR THE SUBMISSION OF FINANCIAL ESTIMATES TO THE FINANCE COMMITTEE AND THE EXECUTIVE COUNCIL:The financial estimates of the University shall be placed before the Finance Committee for its consideration and comments in the month of February and with the modifications, if any, made by the Finance Committee laid before the Executive Council for its consideration and approval in the month of March every year.
